Terms
Buyer and dealer terms
Buyers accept the buyer terms when they open an account; dealers, who may buy too, accept them when they apply. Dealers accept the dealer terms when they apply, and again for every car they list. Below is the text people accept today, with its version. When a text changes it gets a new version, and the site records which version each person accepted, and when.
Buyer terms
Version 2026-10-draft-6 · Draft: final before the first sale.
- One asking price. Every car has one asking price, shown to every buyer. Offers are private, and the asking price never changes because of an offer.
- Private offers. You may have one open offer per car. Mobility1 answers offers for the seller, one at a time and within 24 hours: accept, decline, or a counter-offer to you alone. No other buyer sees your offer.
- Nothing binds until agreed. An offer binds no one until it is accepted for the seller and you both sign the sale agreement. You may withdraw an offer until it is accepted.
- Reserving. To reserve a car, at the asking price or at your accepted offer, you pay the buyer service fee (KES 50,000 including VAT) by M-Pesa or bank transfer to Mobility1's own accounts, or by card through a payment link from our card provider, exactly as shown on your payment page. The first payment to arrive reserves the car and locks it for you for 72 hours. Money that arrives after the car was reserved is refunded in full, to where it came from.
- Refunds. The fee is refunded in full if the seller does not go ahead. If you withdraw after reserving, we keep KES 12,500 including VAT for the checks done for you and refund the rest. Refunds go back to the phone, account or card the money came from.
- Paying for the car. For Kenya stock the dealer is the seller. You pay the price in two parts, which together make the full price: Mobility1's part and the dealer's part. Mobility1's part is the dealer's commission plus VAT, less the withholding tax the dealer pays KRA. The dealer instructs you to pay it to Alf Holdings East Africa Limited (Mobility1) as shown on your payment page, and it counts as paid to the dealer. The dealer's part you or your lender pay into the dealer's business account that Mobility1 checked, as My desk shows it. Pay Mobility1's part within the 72 hours of your reservation; the car then stays reserved for you until the sale is done. If you do not pay it in time, the reservation ends as if you had withdrawn. If the sale does not go ahead, we refund Mobility1's part in full. Mobility1 never holds the dealer's part. UK imports are ordered on request, on separate written terms. Mobility1 never asks you to pay a person.
- Inspections. A Mobility1 inspection report describes the car's condition on the inspection date. It is not a warranty.
- Business buyers. Accounts are for registered businesses. We check your KRA PIN and business registration before your first offer, and use these details only to verify you and to run your purchases.
Dealer terms
Version 2026-10-draft-3 · Draft: final before the first sale.
- You are the seller. You set the asking price of each car and say whether VAT applies. The buyer pays you directly, to your verified business account.
- Exclusive marketing. For the period you choose (7 to 30 days) you do not sell the car elsewhere.
- Inspection first. Mobility1 inspects every car and its documents before it is listed. A failed document keeps the car off the site.
- Offers through Mobility1. You give us your lowest price for each car; it stays private and buyers never see it. You authorise Mobility1, as your agent, to answer private offers for you, one at a time and within 24 hours: to accept on your behalf an offer at or above your lowest price, to decline, or to make one counter-offer that is not below it. You do not see offers. When a car is reserved we tell you the price, and the buyer pays that price to you directly. You never ask buyers to outbid each other, on or off the site.
- Fixed price. The asking price does not change while an offer is open; any change goes back to review.
- Commission. Mobility1's commission is 2.5% of the final price, at least KES 150,000 and at most KES 500,000, plus 16% VAT. You instruct every buyer of a car reserved through Mobility1 to pay this commission plus VAT, less the 5% withholding tax you owe KRA on it, directly to Alf Holdings East Africa Limited as part of the price. That payment counts as the buyer's payment to you and settles the commission. You pay the withholding tax to KRA and send Mobility1 the certificate. Alf Holdings issues its eTIMS invoice to you when its part arrives.
- Handover. You hand over the car and start the NTSA transfer only after Mobility1 tells you that its part is in. Then you confirm on the site that you have your part, from the buyer or the buyer's lender, and enter the transfer reference. If a buyer pays you the full price instead, you pay the commission within 5 working days.
- Your data. We use your company details to verify you, to run your sales and to issue invoices.
